Entering Canada without approval can have significant consequences. There is a special process, however, that may allow entry for a limited time.

ENTRY WITHOUT PERMISSION

If an individual attempts to enter Canada without permission or rehabilitation, Canadian authorities may:

  • Refuse them entry.

  • Take enforcement action including arrest, detention, or removal.

  • Advise them to apply for temporary and discretionary entry.

REMAINING IN CANADA WITHOUT PERMISSION

If an individual is found in Canada without permission or rehabilitation, Canadian authorities may:

  • Ask them to leave voluntarily.

  • Take enforcement action including arrest, detention, or removal.

  • Advise them to apply for temporary and discretionary entry.

SPECIAL PERMISSION TO ENTER

There is a unique process where an individual who has not met the waiting period or other criteria may apply for a Discretionary Entry or a Temporary Resident's Permit.

The application process is generally the same. Fortunately, the fee is waived while Canadian authorities review the information and issue further advisement.
